Суд ЕС отказал "Алмаз-Антею" в снятии санкций

В первой инстанции вынесли решение о сохранении санкций ЕС против "Алмаз-Антея". Есть еще вторая инстанция.

Не смотря на то, что сейчас много где заявляют, что суд признал поставки российского оружия в Украину, насколько я могу судить, суд только заметил, что Европейский совет(принимающий решения о санкциях) установил данный факт, а "Алмаз-Антей", собственно, не оспаривал.

The Council also established that Russia actually supplied weapons to the separatists in Eastern Ukraine.

Furthermore, the Council produced numerous press articles reporting on the shooting down of Ukrainian army aircraft and helicopters by the separatists, including, in particular, a military cargo-plane transporting 49 soldiers. Those press articles, which come from several different sources and are sufficiently specific, precise and consistent as regards the facts there described, corroborate the existence of Russian involvement in the conflict in Ukraine, in particular through the supply of weapons and military equipment to the separatists in Eastern Ukraine. The Court further points out that Almaz-Antey has not called into question the purely factual information reported in those articles, nor has it even sought to establish in what way they are manifestly incorrect.

И MH17 к санкциям отношения не имеет:

As regards the destruction of Malaysia Airlines flight MH17 [...] the issue [...] is irrelevant, given that that incident was not decisive in the reasons given for the freezing of the funds of Almaz-Antey.

Да и вообще:

Finally, the Court considers that the Council was not required to demonstrate positively that the weapons which Almaz-Antey produced were used in Ukraine by the separatists.

В общем, санкции за то, что "Алмаз-Антей" - госпредприятие, под достаточным контролем государства, и поставляет оружие этому государству, а государство отправляет какое-то (не обязательно именно алмаз-антеево) оружие в Украину.



Upd.: Собственно решение - выше только пресс-релиз.

Насколько я могу судить, аргументы "А-А" сводились к
1) Нам ничего не сказали
2) Это не мы
3) Ваши доказательства - не доказательства
